Definition of Data
Personal data is any information relating to an identified or identifiable natural person; an identifiable natural person is a person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
In its everyday business operations Kapacity.io makes use of a variety of data about identifiable individuals, including data about:
- Kapacity.io Software Service users
- Kapacity.io Software Service partners and customers
- Users of its websites
- Subscribers
- Other relevant stakeholders
In collecting and using this data, the organization is subject to a variety of legislation controlling how such activities may be carried out and safeguards that must be put in place to protect it. This privacy notice does not apply to the personal information we process as a “data processor” on behalf of our customers. In those situations, the customer that we provide services to and with whom we have entered into a data processing agreement is the “data controller” responsible for your personal information, and we merely process your information on their behalf in accordance with your instructions. Why do we collect your personal data?
We collect your personal data only when there is a legal basis for it. When providing Kapacity.io Software Services your personal data is processed in order to fulfil our obligation to you. This data is necessary in order to give you the services that you expect. We do not store your personal data longer than is necessary to fulfil the purpose with the processing.
The personal data we process varies depending on which part of the Kapacity.io Software Service we provide to you and how the Partner Service is designed. Below you will find a description of what data we process related to the different services we provide.
How we use your data and the legal basis for processing
We use your data for different purposes, both business and commercial. These purposes include delivery of the Kapacity.io Software Service, improving this service as well as developing new Services.
Specifically we also use your data in order to perform product- and customer analysis, statistics and business- and method development. Furthermore, data may be processed for the purpose of ensuring that we have performed the Kapacity.io Software Services correctly. It can also be necessary to process personal data in order to provide customers support to you or our Partners.

Transfer To Third Countries
Information we collect about you can be processed, stored and transferred between all Kapacity.io subsidiaries in the countries we operate in. However, Kapacity.io will not transfer the personal data you provide us to countries outside the European Economic Area (EEA) without explicitly informing you about that transfer.
Categories of Personal data we collect
Kapacity.io website
We handle the personal information you provide to us by filling in different types of forms. For corporate representative accounts we process personal information such as name, email address and possibly phone number.
Direct Marketing
We use your personal data to send company news, updates, information about other similar products and services, Kapacity.io’s events and newsletters, etc. Personal data you provide to us by filling in the forms on our webpage is used only with your consent. We process the following categories of personal data: name, surname, company name, email address, phone number. We store your data for direct marketing until you withdraw your consent.
From Partners
In some instances we are provided with information from our Partner(s). This is information that you have already provided to our partner and that is necessary for us in order to provide the Kapacity.io Software Services to you. This can be information such as your email address or your building’s address.
From you
We also collect information directly from you. This includes information which is necessary for communication and interoperability with the relevant device. The Partner Services can also be designed such that you are prompted to provide information such as your address to us which might be needed for the performance of the respective Kapacity.io Software Service.
We collect some technical data automatically through the use of our website or Kapacity.io Software Service. This includes IP address, type and device ID of the device as well as mobile operating system, browser type, browser version, the specific sub-sites of our website that the you, the time and date of the visit, the time spent on those sites, unique device identifiers and other statistical data.
From your device
The provision of the Kapacity.io Software Services requires us to collect information from your device. This can be information such as set point temperature or change of state. Note that we will only collect such information on the basis of an explicit consent.
